Vermont family law - appeals


Any final order of a Vermont court can be appealed to the Supreme Court of Vermont as a matter of right. A notice of appeal must be filed within 30 days of the final order. After 30 days, in limited circumstances, changes to  orders can be pursued by filing a Motion with the Court requesting a modification of orders. (link to modification of orders page) Certain issues may be appropriate for interlocutory appeal, which is an appeal of a ruling that is made prior to a final order.


The appeals process involves reviewing the record of the trial court and the findings and reasons for those findings. Appeals to the Vermont Supreme Court may be heard by the full panel of five supreme court justices or, in cases where the court determines that there are no new issues of law, a panel of three justices may hear the appeal.
