DRM’s experienced bankruptcy and business restructuring attorneys guide business clients and creditors through the complexities of bankruptcy and insolvency.

DRM 's bankruptcy and business restructuring team helps local, national and international business clients and creditors resolve complex financial disputes both in court and outside of court. Our business lawyers are experienced in negotiating and restructuring financial transactions, as well as the sale or acquisition of distressed assets or businesses, and our bench-tested litigators are prepared to handle litigation concerning these matters in or out of bankruptcy. Our team is also experienced in advising clients whose customers and counterparties are experiencing financial distress.


The Bankruptcy & Business Restructuring team has wide experience advising business clients and lenders in the following areas:


  • Bankruptcy and Insolvency – We represent secured and unsecured creditors and other interested parties (such as landlords) in all aspects of reorganization and liquidation proceedings, including prosecution of claims, relief from stay, sales of assets and the prosecution and defense of adversary litigation. Our attorneys have experience in federal bankruptcy court, state court, insurer insolvencies and state court receiverships.
  • Complex Foreclosure Litigation – We handle complex foreclosure litigation and related permitting, environmental and condominium law issues. We frequently represent lenders in the enforcement of security interests under the UCC.
  • Loan Workouts and Business Restructuring – We represent lenders and borrowers in workouts of distressed real estate and commercial loans. Our attorneys analyze relevant loan and financial documents, consider any permitting and environmental issues and work with the client to develop and implement a strategy tailored to the client’s objectives. Our attorneys also work with lenders and borrowers to restructure business financing relationships when existing terms do not meet the needs of the parties.
  • Lender Liability Defense – We represent lenders in a variety of lender liability actions in all state and federal courts, including Truth in Lending and consumer fraud. Our attorneys also counsel lenders on documentation and loan enforcement issues to minimize the risk of lender liability exposure.
